Privacy Policy
1.1 — Data Controller. DesignGridWorks, registered at Rua Soldado Luís 2, 2910-019 Setúbal, Portugal, is the data controller responsible for the processing of personal data collected through this website.
1.2 — Data Collection. We collect personal data only when voluntarily submitted through our contact forms, including: full name, email address, phone number, and project details. This data is collected solely for the purpose of responding to inquiries and delivering requested services.
1.3 — Legal Basis. Processing of personal data is based on Article 6(1)(b) of the GDPR — performance of a contract or pre-contractual measures taken at the data subject's request. Additionally, processing may be based on Article 6(1)(f) — legitimate interests in responding to business inquiries.
1.4 — Data Retention. Personal data is retained for a maximum of 24 months from the last point of contact, unless a longer retention period is required by law or necessary for ongoing contractual obligations. After this period, data is permanently deleted from all systems.
1.5 — Data Sharing. DesignGridWorks does not sell, trade, or transfer personal data to third parties. Data may be shared with subprocessors only when strictly necessary for service delivery (e.g., hosting providers, payment processors), and only under equivalent data protection agreements.
1.6 — Data Security. All personal data is processed using industry-standard encryption protocols (TLS 1.3). Data is stored on secure servers within the European Economic Area (EEA). We implement appropriate technical and organizational measures to protect against unauthorized access, alteration, disclosure, or destruction.
1.7 — Your Rights. Under the GDPR, you have the right to: access your personal data (Art. 15), rectify inaccurate data (Art. 16), erase your data (Art. 17), restrict processing (Art. 18), data portability (Art. 20), and object to processing (Art. 21). 1.8 — Supervisory Authority. You have the right to lodge a complaint with the Portuguese data protection authority: Comissão Nacional de Proteção de Dados (CNPD), Av. D. Carlos I, 134-1.°, 1200-651 Lisboa, Portugal.
Terms of Service
2.1 — Acceptance. By engaging DesignGridWorks for any service, the client ("Client") accepts these Terms of Service in full. These terms constitute a legally binding agreement between the Client and DesignGridWorks, registered at Rua Soldado Luís 2, 2910-019 Setúbal, Portugal.
2.2 — Scope of Services. DesignGridWorks provides web development, design, and related digital services as described in individual service proposals. The scope of each engagement is defined in the corresponding project proposal or statement of work agreed upon by both parties prior to commencement.
2.3 — Project Execution. Projects begin upon receipt of the agreed deposit. Milestones and deliverables are defined in the project proposal. DesignGridWorks will maintain regular communication throughout the project lifecycle and provide progress updates at agreed intervals.
2.4 — Client Obligations. The Client is responsible for providing all necessary content, assets, credentials, and feedback in a timely manner. Delays in Client responses may result in corresponding project timeline adjustments. DesignGridWorks is not liable for delays caused by incomplete or late Client deliverables.
2.5 — Intellectual Property. Upon full payment, all final deliverables and associated intellectual property rights are transferred to the Client. DesignGridWorks retains the right to display completed work in portfolio and marketing materials unless otherwise agreed in writing.
2.6 — Limitation of Liability. DesignGridWorks' total liability under any engagement shall not exceed the total fees paid by the Client for the specific service giving rise to the claim. DesignGridWorks shall not be liable for indirect, incidental, or consequential damages.
2.7 — Confidentiality. Both parties agree to maintain the confidentiality of proprietary information shared during the course of the engagement. This obligation survives termination of the agreement for a period of 24 months.
2.8 — Governing Law. These Terms of Service are governed by the laws of the Portuguese Republic. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts of Setúbal, Portugal.
Refund Policy
4.1 — General Policy. DesignGridWorks is committed to delivering services that meet agreed-upon specifications. Refunds are evaluated on a case-by-case basis according to project milestones completed and deliverables produced.
4.2 — Pre-Work Deposits. Initial deposits paid before work commences are refundable within 14 days of payment, provided no work has been initiated. Once work begins, the deposit becomes non-refundable as it covers project setup, resource allocation, and planning.
4.3 — Milestone-Based Refunds. For projects structured around milestones, refunds for incomplete milestones are calculated proportionally. The Client is entitled to a refund for any milestone where work has not yet commenced or where deliverables do not meet the specifications outlined in the project proposal.
4.4 — Completed Work. Fees for completed milestones and delivered work are non-refundable. This includes work that has been reviewed, approved, and deployed by the Client. Disputes regarding quality of completed work will be addressed through revision rather than refund.
4.5 — Refund Process. Refund requests must be submitted in writing to [email protected] within 30 days of the relevant payment. Refunds are processed within 14 business days of approval to the original payment method. DesignGridWorks reserves the right to deduct reasonable administrative fees from refund amounts.
4.6 — Cancellation. Either party may terminate the agreement with 14 days' written notice. Upon termination, the Client is responsible for payment of all work completed up to the termination date. Unused pre-paid fees for uncompleted work will be refunded in accordance with section 4.3.
